Ch 7.) Drugs - Student Drug Screening
Some schools are administering urine tests to teenagers to determine if they have been using drugs. Tobacco has recently been added to the list of drugs tested in some of these schools. Random drug testing of students has been affirmed by the U.S. Supreme Court, but opponents say such tests violate the students' rights. Please answer the following questions. If you prefer protect your opinions from your peers, please hand in your answers on a sheet of paper.
1. Do you think it is an invasion of individual privacy to be subjected to random drug testing in school?
2. How about for participating in extracurricular activities?
3. Do you think tobacco products should be included in the drug testing programs?
4. Is tobacco a drug?
5. What Constitutional Amendment pertains to individual privacy?
6. Do you think random drug testing should be allowed for places of employment?

1. It is an invasion of privacy to allow random drug testing to students in school. There is no need for the drug testing and the results are not kept private throughout the school. Random drug testing could cause a lot of problems to students and cause more disruption in our already disrupted schools.
2. Extracurricular activities should be treated the same way. If a student tests positive for drugs and then are kicked off of the sport team, their status is no longer private. There is no way to maintain privacy when you are testing individuals such as high schoolers who have a need to know what is going on all the time.
3. Tobacco products should not be included. For forensic purposes, yes, because the fact that someone is a smoker or uses tobacco might be used to solve a case. But, for the purposes of eligibility and high schools, drug testing should not be allowed.
4. Tobacco is a drug. It is something that people get addicted to and have very serious and harmful long term effects.
5. The Fourth Amendment protects "reasonable expectation of privacy".
6. Just like schools, random drug testing should not be allowed in places of employment because that person may be subject to gossip and other harmful things will happen to them.
1. If the Supreme Court upheld it than it's legal, end of story. So I'm ok with it.
2. That's ok too, for the same reason as #1.
3. Yes, but only if the student is under 18, because tobacco is illegal if they are under 18, if they're older then 18 than tobacco would be fine.
4. Yes.
5. The 1st, which allows private beliefs, the 4th, which protects against warrentless searches and seziures, and the 5th which allows the right to remain silent.
6. Yes, if employers want to test their employies than they should be allowed to, especially if employies are breaking laws while working.
1.) I do think that it is unfair that people's privacy is being affected. If teenagers want to do drugs and ruin their life then it is up to them. The Government should not have a say in what a kid does. It is up to the parents that are raising the children to tell them right from wrong.
2.) No, kids should be doing extracurricular activities because it allows them to be someone and see what they like to do with their time. It also allows them to enjoy different things and see what they may be good at.
3.) Not really, I mean that all depends weather a child is abusing it or using it once in a while. Kids are only going to do things because they know it is the wrong thing to do and because they want to seem like they don't really care about things that are going on around them.
4.) I do believe that tobacco is a drug.
5.) The Fourteenth Amendment.
6.) yes, because if someone is abusing drugs then it can affect people around them. But if people want to abuse it at work then something should get done, and changes should happen.
1.) it is not an invasion of individual privacy for random drug tests at school because students are subject to a lower type of law than adults when present at school. The school is a form of Government and they have their own rules that students must obide by.
2.) Absolutely for extracurricular activities because we need to make sure that young athletes are not trying to cheat the game and so they can learn to play the same way everyone else does.
3.) In school yes, because schools are tobacco free areas and it is illegal to use tobacco in anyway on school property.
4.) Yes because it is addictive and can have many harmful effects on the body.
5.)1st, 4th, 5th. The first is freedom of religion, press, speech, assembly, and the right to petition. The 4th because it protects against unreasonable searches. The 5th because it ensures the due process of law.
6.) Yes, the employer should have every right to see if their employees are doing drugs and whatnot and can choose to fire certain employees if they are doing drugs, because drugs are illegal.
1) I do not believe that the random searches issued by the police are an invasion of privacy. The supreme court has determined that these tests are not an invasion of privacy in the past. So, I agree with the random tests.
2) Extra curricular activities are usually part of the school and therefore are subject to the same searches and random testing. I do believe that they are totally legal and required.
3) Yes, I believe that the testing of tobacco should also be used because, if it is in a school, tobacco is illegal, therefore it should be tested for.
4)Yes, I think that tobacco is a drug.
5) I believe that the 1st, 4th, and 5th amendments pertain to this "invasion of privacy".
6)Absolutely, The employer needs to be testing their employees for drugs. The employer should not be supporting any drug takers. In summary, Yes I do believe they should test for drugs in the work place.
1. I don't think it is unreasonable for schools to have the necessary tools for drug testing, but I don't think it should be done randomly. If the school has reason to believe that a pupil is using drugs in school, then yes, they have the right to test. Other than that, it is an invasion of privacy.
2. Again, I think it is okay if the advisers have reason to believe that they are bringing these things to the event/activity. If they don't have any leads though, they don't have the right to just randomly drug test them.
3. It should because students under 18 don't have the right to use tobacco, and tobacco is not allowed on school grounds anyway.
4. I think that is a drug because it contains things that are addicting, but isn't as serious as some of the other drugs. It does however, have many negative side-affects.
5. The 4th amendment protects American citizens from unlawful searches of property.
6. Yes it should. Just like at school, drugs aren't allowed in the workplace. If an employer has reason to believe that their employees are using drugs at work, they should be allowed to test them.
1.) I don't think it is an invasion of privacy because if the students have nothing to hide it shouldn't bother them to get tested.
2.) Students doing extracurricular activities should get tested because there are plenty of people out there who use drugs to preform better when playing sports.
3.) Yes, because it is illegal for students under 18 to be given tobacco so they shouldn't be smoking or chewing it.
4.) Yes tobacco is a drug because it can get people addicted to it and it affects how they feel.
5.) Individual privacy is covered loosely under the 14th Amendment.
6.) Yes, drug testing should be done at the job for the safety of the person and others around him or her. Some drugs can prevent the employee from doing their job well.
1. Drug testing in school should be given at random and students should be required to take it. School principles should be allowing students to come to a safe school and there for the student are also required to be clean and safe while on school grounds.
2. Yes. More of less people also participating in a school organized event or club should also be subjected to the school policy.
3. Yes. Tobacco should be included because it is illegal to smoke on school grounds and it is also illegal to be in possession of tobacco under the age of 18
4. Yes, Tobacco is a drug because it can create an addiction. It also causes extreme harmful effects to the body.
5. the 4th amendment protects against search and seizure.
6. In some places of employment there should be required drug testing. In schools if they submit to students taking random drugs tests that teachers also need to as well. Most places of employment should require drug testing.
1. No, because when you are going to school you should not be doing drugs in the first place. It is against the law to smoke or do tobacco until your are 18 years old. I do not think it is an invasion of privacy because you should just be smart enough to not smoke or do tobacco and other drugs before or during school.
2. It isn't and invasion of privacy because it would be dangerous to do drugs and be in a sport. People who do sports in a high school level should be tested for drugs just as much as other athletes are.
3. Yes, unless you are 18 years old, you should not be using tobacco, if you are 18 and in school it shouldn't be a problem, but these people should not be using tobacco on school grounds, it is illegal.
4. Yes, I think that it is because it messes up your system. No matter what type of tobacco you use, smoking or chewing, you mess up something. With chew, your gums get gross and your teeth can rot, which happens with other drugs too.
5. The Fourth Amendment protects you from individual privacy. Cops can't just go into your house without a warrant. The Fourth Amendment expects that you have privacy.
6. Yes, because it really wouldn't be right for someone to go to work on drugs. This puts a name on the company they work for. People should do things like this on their own time, not when they are working for other people or while in school.
1.Yes, it is an invasion of privacy to have random drug testing in school. The testing should be done willingly and under parental consent. Photos and internet use need parental and the student's consent why not drug testing which is much more private. The testing would ruin the reputation of the student and they will be looked upon differently if the results are positive.
2.It is still an invasion of privacy because the team and the school will know that the test was positive when they aren't allow to stay on the team, no privacy.
3.Yes, if there is a drug testing then tobacco should also be tested for because it is considered a drug, but the students should not be randomly tested for it.
4.Yes. it is a drug because it is harmful to the person's health, it is addicting, and it does give the person some sort of high, or relief.
5. amendment 4, search and seizure, can not search with out warrant, protection of the person's privacy.
6.No, because it is still an invasion of privacy and may make them loose there job or looked at differently
1) Yes i think, it is invasion of individual privacy to be subjected to random drug testing. The school should not get involved in what the student does. Only if the student brings the drugs to school.
2) Sport player should be tested though because of some drugs like steroid.
3) No, because some students are 18 and can have tobacco products.
4) Yes tobacco is a type of drug.
5)1, 4, and 5 amendment pertains to individual privacy.
6)Yes, because people are paying you to work for them and drugs can affect the way you work. Also some jobs it would be wrong for a employee to do drugs. Ex. teacher
1. Random drug testing could be a very powerful tool on the war on drugs in our school systems if more widely used. These random drug test will stop drugs from being brought into our school but mostly help those who need help with their addiction
2. Drug tests should be used the same way for extracurricular activities. In this day, and age known as the "steroid era" of sports, teen athletes are exposed to the world of steroids and performance enhancing drugs even more than before. Drug testing should be mandatory in high school sports where the players have no clean role models.
3. School should also test for tobacco in students under the age of 18. Tobacco is one of the easiest drugs for students to get and many students smoke tobacco regularly.
4. Tobacco is one of the most harmful and addictive drugs and is very easy to obtain.
5. The 4th Amendment of the constitution protects the right of privacy of individuals.
6.Places of employment should also use drug testing to check employees before they are hired. The tests will give the employers a good idea of the worker and what type of person they are.
I think that it is an invasion of privacy. And that not because i use drugs. I just think that school is a place to learn not a place for teachers to get involved with a students life in that way. It not just teachers its the school disteract. I think that the drugs part is for the parents to take care of not the school. The parents should be teaching there kids how to act and the responsibilty they need. Its not up to the district.
2. I think that if you are involved with sports then yes you should be drug tested. But only at the bigging of the season. I think that it is important for a student not to be taking drugs while they are doing physical activities. BUt if you are involved with a club then no there is no reason for that.
3. No i dont think that they should. Smoking yes will interfere with your everday life. BUt it wnt kill you instantly. I just dnt think that smoking is as bad as regular drugs like a wrestler would take.
4. Tobacco is a drug. You can get addicted to it. It has effects and long term effects.
5. Amendment 4
6. No its the same as being in a school with many people its your personal life not anybody elses.
I believe that it really is no big deal, our school is a drug free environment and that if you do drugs and get caught well that is your problem. Having random checks may decrease the amount of drugs kids do. If you do not do drugs then you shouldn't have a problem with taking a test.
I think that is a big thing because kids who are in extracurricular activities like NHS and do drugs but the adviser is not informed and they get caught it serves them right, cause if they are drug addicts they shouldn't even be part of those groups...
yes i do believe all drugs should be involved except for perscription drugs, because of medical reasons.
yes!
Amendment 4
yes i do!
1. I believe that there is a need for drug testing in schools because whether people realize it or not drugs are a huge problem and violate the safety of students who have chosen not to do drugs.
2. Extracurricular activities should be subjected to drug testing as well because if you are making the commitment to join the activity you should not be using drugs, it is unfair to your teammates and other teams.
3.Tobacco products should be included it certain situations. If the student is 18, then it is perfectly legal for the student to have tobacco on their system so it shouldn't be held against them. But, if the student is under 18 they can't legally have tobacco in their system so in this case I think it should be used.
4. Tobacco is a drug, a very addictive one.
5. The 4th amendment protects citizens against individual rights.
6. Yes, drug testing in the work place should be allowed because the employers have the right to know if there employees are doing something illegal during work hours.
1) Yes, why do the teachers really need to keep tabs on what kids do drugs. This is just setting school up for tons of bias between teachers and student. Some highly respected students do drugs. Why would you want to bring down their reputation and treat them diffrently.
2) No, i believe the same rules apply, drug testing would cause unneeded bias towards students.
3) No, whats it with adults getting on the kids cases, its their choice for what they do with their body.
4) Yea, kills thousands of people every year. Yet some other "drugs" have not killed anyone. Ex. Marijuana
5) The 4th amendment pertains to search and seizures. It protects individuals, and gives them rights over what they can and cannot hide.
6) Certain drugs should be screened. We dont want meth fiends working as our teachers.
1. I don't believe that random drug testing in schools is an invasion of privacy because drugs are illegal and shouldn't be tolerated in schools. These tests will be hassle, yes. but they will help solve a problem that's found in schools so often. They will stop the problem before it gets out of hand.
2.The same thing should go for extracurricular activities, because they are school teams and the school should have control over whether or not their students are using drugs.
3.I think they should, because most high school students aren't old enough to smoke legally.
4.Tobacco is a drug, because it's something someone can get addicted to and do some serious damage and have some harmful effects in the long term.
5.The fourth amendment allows school officals with reasonable suspicion to search any student or their belongings on school property if they have a suspicion.
6.I think that if you are an employer and you want to be in total control over your employees then drug testing in the work place would be a good idea. You want your business and workplace to be a safe place for your customers and other employees. It may be a hassle to do but its better safe than sorry.
1.) I do not think that having random drug test in schools are an invasion of privacy. Principals have the right to protect and keeps their school safe so if they think that having random drug tests is the best way then so be it.
2.) Extracurricular activities should be no different. If you don't get tested and then you get caught, you are not the only one who loses their reputation. This issue is bigger than just the privacy of athletes. It involves the school and the community.
3.)Yes I think that tobacco should be included i the testing but only if they are under the age of 18. But if they are 18 then that would would be fine because they are legal to smoke.
4.) To me tobacco is not the drug but the chemicals that are in the cigarettes that are addicting.
5.) I think that the amendments that pertain to the to individual privacy would have to be the 1st, 4th, and 5th.
6.)Yes I do think that the random drug tested should be allowed at the places of employment because the employers should know who they hiring and how that would effect their business.
1) I think it is an invasion of privacy, but if the drugs are brought into the school then the student should be tested.
2) I do not think drug testing should be done in schools, unless there is an issue of safety or it is brought into the school. It should not matter wether the student is an athlete or not.
3) Tobacco is available OTC and does not effect school work so it should not be included in drug testing programs.
4) The drug in tobacco is nicotine.
5) The Fourth Amendment protects against unreasonable searches and seizures.
6) I think that random drug testing should not be done at work unless there is a reason to, if it starts to affect their work than there is a reason and it should be done.
1. I do not think there is a need for schools to conduct random drug tests on students. Since students are required to go to school there should not be any consequences for activities done outside of school.
2. But as far as extracurricular activities go I think drug testing should be allowed because students are willing participants and should abide by any policies put forth by the administration.
3. I do not think that tobacco should be included in the drug tests. It is not an illicit drug and it may be possible for someone to have a false positive because of secondhand smoke.
4. Tobacco is a drug, mostly because of the nicotine which has been proven to be highly addictive.
5. The 4th amendment addresses the concerns of privacy.
6. I do think drug testing should be allowed in places of employment. The safety of all the workers is a responsibility of management. Productivity might be affected if employees were using drugs at work or at home and employers should have the right to hire non-drug users.
1. I do not believe that drug testing in schools is an invasion of privacy. Drugs are illegal and the kids using them know that and they should have to face the consequences. Every kid has the right to come to a safe school, and if kids are using drugs, it is not safe.
2. Students who are in extracurricular activities should also be able to be tested. They are part of the school and should be subject to the same rules. It is not fair if a student athlete gets tested who is not doing drugs, and a person in a club doesn't get tested and is doing drugs. Drugs should not be used anywhere in the school.
3. Tobacco should also be included in the testing. It is illegal if you are under eighteen and it is not allowed on school grounds.
4. Yes, tobacco is a drug. It is addictive and contains many harmful substances. It also has many harmful side effects.
5. The Fourth Amendment pertains to individual privacy.
6. I do think that drug testing in places of employment should be allowed. If they are doing drugs on the job, they are putting not only themselves in danger, but someone else's life in harms way.
1. Drug testing in school is an invasion to the students. Theres no need to have drug testing in school because it would just cause more problems in our schools.
2. Even in extracurricular activites shouldn't be testing for drug use because it's not private. Because if you test postive your automatically kicked off the team, and it will get around why.
3. Tobacco products shouldn't be included. The fact that someone is a user of tobacco it may be helpful to solve a case. But just for high schools ,it shouldn't be tolerated.
4. Tobacco is a drug. Tobacco is something that people get addicted to and can have serious and harmful long term effects.
5. The Fourth Amendment protects "reasonable expectation of privacy."
6. Random drug testing should not be allowed to become employed, just like schools. It could get around and start gossip.
1. Yes
2. Definitely.
3. Not if the test decides if someone keeps playing on a sports team or not.
4. Yes
5. 4th
6. That all depends on the place of employment.
1. No i don't believe they should its an invasion of privacy.
2. I believe this is ridiculous. It doesn't protect our privacy because people will find out that that is the reason you get kicked off the team or why you didn't make the team.
3. No.
4. Yes
5. 4th
6. No it shouldn't be allowed at place of employment. It doesn't protect our privacy.
1. It is an invasion of privacy, if someone does it let them be there doing it to themselves and not hurting anyone else, under certain circumstances. Also if someone you think would never try it and happens to the night before and gets tested next day randomly, even if they dont ever do t again there screwed.
2. Same Answer as number 1
3. Only if the individual is under the age of 18, tobacco is just plain stupid.
4. According to the government no.
5. 1st,4th, and 5th, all pertain to this, no real amendment for privacy, you defend it yourself.
6. I do not believe they should have the right unless its in a contract and signed by you, the only way you should ever get fired or anything for drugs is if, you do it at work and get caught.
1. No I don't think this is an invasion of privacy because drugs are illegal and students should be tested for their safety and the safety of others around them. Some may believe this in an invasion of privacy, but in a public place such as school, and school property, students should not be having to hide these things. I believe random drug testing would be a good idea.
2. I do not think it is an invasion for sports either for the same reasonings as listed above. Drugs are illegal and students should not be using them at any time. IF students are using drugs on a sports team, they should be kicked off.
3. I do for students who are under 18. But, for students who are over 18, tobacco IS legal.
4. Yes, tobacco is a drug. It is addictive and also harmful.
5. The fourth amendment which protects against unreasonable searches and seizures.
6. Again, I believe random drug testing SHOULD be allowed for places of employment. Managers and employers should always have the right to know if their workers are under the influence. If they are under drugs, they are not responsible enough to hold a job, and their employers should know that their employees are doing drugs.
1. I think that it is a definitely an invasion of privacy to be giving random drug testing in school. Unless the student has given them probable cause to test them for drugs, the school should not be testing them.
2. I do however think that if a student wishes to be in an extracurricular activity, they should be tested for drugs before being able to participate. However, this should only be for sports, not for clubs. If a student wants to join a sport, it's for their own health to get drug tested.
3. I do believe that tobacco should be apart of drug testing. I only believe this for sports as well as the question before. It is for the students health.
4. I believe that tobacco is a drug, because it is something that someone can get addicted to.
5. The 4th ammendment.
6. I think that random drug testing should only apply to certain employments. It depends on what the job is.
1.No, because once we enter school we lose most of our rights to be able to keep the environment safe. Although with these school drug tests the main thing here would be the fact that are the tests being administered to certain randomized students, selected groups of students, or all the students in general. If it was either randomized lists of students or all the students it would be considered okay but if it was just a group targeted then it would not be alright.
2.It depends on the extracurricular activity. If it is a sport then there probably should be drug testing. Only because this way we can insure the games are being played fairly by talent not by drugs assistance. But if it is something like the Art club or the Chess club, how would they benefit from doing drugs? There would be no need to administer the drug tests to them. It would be a waste of time and money.
3.Tobacco is a drug and should be included because people do get addicted to cigarettes and other tobacco products. They can cause certain sport players to be out of shape, etc. Though it would make sense to include tobacco if the student is only under 18. One has to be at least 18 and older to legally smoke.
4. Yes.
5.It is the sixth Amendment that protects a persons right to have reasonable expectations of privacy.
6.Yes, because some places have heavy machinery. If the bosses do not know if their workers are under the influence of any kind then there could be injuries and possibly death. Machinery needs a clear mind and concentration. With drugs it effects both the mind, concentration, and others that could make the worker ineffective and dangerous.
1.) yes, I do think it is an invasion of privacy to do a random drug search because it could cause more problems for the school and students.
2.)I think if a student is doing extracurricular activities then yes the should have random testes because even with the activity's they could still be doing things.
3.) Yes, they should include it because kids are still in high school and they are under age.
4.) yes tobacco is a drug because you can get addicted to it.
5.) the fourth amendment.
6.) yes, because people should not go to work on drugs because they wont be able to do there job right.
1. It is an invasion of privacy to do random drug testing in schools. It's like going up to someone who doesn't do drugs and saying oh we think your a drinker, let's test you.
2. Extracurricular activities should be tested. Especially athletes for reasons that are already know, thus why they do it.
3. Yes but only to those under 18. At 18, tobacco is legal.
4. Yes it is. It's highly addictive and causes serious damage to a persons mind and body.
5. The 4th.
6. Yes it is. Many people go to work high or drunk and are not caught. That is not right.
1. I somewhat feel that it is an invasion of privacy and very time consuming. Students shouldn't have to be subject to random drug testing at school where they are meant to learn. I feel it would cause alot of problems and disruptions in the school.
2. I think that drug testing should be allowed for extracurricular activities however because students could be trying to get an edge by abusing substances to better their game.
3.I don't think that tobacco should be included because tobacco is legal at the age of 18. I would understand if it were illegal but I feel it shouldn't be included.
4. I think tobacco is a drug because it can be very addictive and harmful effects.
5. The Fourth Amendment
6. I think that the employer has the right to know if their employees are using drugs so therefore i feel that drug testing should be allowed in the work place.
No, all students should have to pass drug tests. Students should be tested regardless of their participation in extracurricular activities. Tobacco should be added for students who are underaged. Tobacco is a drug because it is an addictive substance. Random drug testing should be used in schools and the workplace to ensure that no laws are being broken.
I don't think it is an invasion of the students privacy. Students give up some of their rights when they enter the building. their schoolbags and lockers are free to be checked at any time and so a drug test is not that invasive anyways. If they don't want to get in trouble the answer is easy, DONT DO DRUGS.
Students who participate in sports should be checked more then other students. To be in a spprt is a privilege and they need to be in good physical condition. They could hurt themselves or others for playing sports while on drugs.
Tobacco should be checked in students under the age of 18. For them it is an illegal substance.
Tobacco is a drug. It contains addicting chemicals and effects a person mentally.
the forth and fifth amendments.
I think it should be. No employee will tell you they do drugs and for some jobs they need to be aware of what is going on and could be disastrous if they are being effected by some drug. A drug test would be the only way to find out if they use any.
1. i think random drug tests are not random at all, i think they pick the people that they think do drugs to test. but do i think it is an invasion of individual privacy..no, because you are going to school and they want to make the school as safe as posible. if you dont do drugs then you have nothing to worry about, and if you do do drugs then this should help stop that.
2. if you are taking illegal drugs to make you better then ya i think they should do drug tests, because its not fare to the others in the sport.
3. i wouldnt see why not, it is a drug
4.yes
5.
6. i think drug test should be allowed for employment, if your doing drug and trying to work i dont think thats right because then your just going to spend the money on more drugs, and plus i dont want druggies working with anything i would be eating or buying
1.well to me I think there should be because incase somebody is high on cocaine so there will be no harm on the school but if you are tested as positive on lets say a proscription drug that you really need I don't think there is harm on the proscription drug's part just the illegal ones.
2.I don't think that the people who take drugs that are illegal shouldn't be in the sports because it wouldn't be fair like if a person takes storiods and has big muscle mass to win a race or a game that's not fair that's cheating.
3.yes I think so because mostly the school's are a tobacco free zone to make a healthy life style and tobacco is a drug too so yes I think they should.
4.yes it is because it is in cigarettes that you can be addicted to which chewing tobacco and cigarettes has lots of chemicals and has nicaten in it that makes you addicted also.
5.the fourth amendment.
6.yes because schools does it too
1. It is an invasion of privacy to have random drug test at school because most of the time the results aren't kept private. I do believe that a student should be able to be searched if they have given the authorities reason. 2. I do believe that to be able to participate in school activities random drug searches or test should be done. 3. Yes because since most high school students are under the age of 18 which is the legal age to buy tobacco products so they should not be brought into school. 4. Yes, because it's addictive. 5. The 4th Constitutional Amendment 6.I think that if random drug searches aren't allowed in school they should also not be allowed at places of employment.
1.) I do not think that random drug testing in the schools is an invasion of privacy. When we walk into the school we are now on school property, and we have to follow the school "laws." The school has the right to enforce their law of a zero tolerance policy, so students should be subject to random testing. A school is supposed to be a clean, safe environment, and administrators have the right to ensure that.
2.) Almost all extracurricular activities, have policies that state that all those who are participating must remain drug free. They have no way to enforce this, unless they do random drug tests. I think this random testing will keep things in order and running smoothly, because nobody will ever know when to expect it, so they will always be clean. If it is a school policy, than these activities count as well.
3.) Tobacco should also be included in the random testing, because it is a drug and it is illegal for it to be used on school property.
4.)Tobacco is a drug. There is no other way to describe it. It has addictive side affects, and irreversible results.
5.)The Fourth Amendment protects individuals from unlawful searches.
6.) I think that almost all places of employment should do random drug testing. When you go into work, you are stepping into a professional setting, and it should be a drug free environment.
I think drug tests in school would be okay if it was everyone who was tested all at the same time. Random drug tests on random students can cause a lot of problems for the students and the school. Students who are suspected and tested for drugs may get a bad reputation from the search. It also disrupts class time which can difficult for students and teachers.
I think if you are on a sports team you should be tested. Being on drugs and playing a sport can cause harm to the team as well as the individual. Certain drugs combined with an excessive amount of physical activity can cause real harm and risk death or permanent injuries. It would benifit the school, the players, and the team if athletes were tested.
I do not believe any one should use any sort of tobacco products ever, or drugs for that matter, but tobacco products do not cause the same impairments as other drugs do. Testing for tobacco products would be unnecessary.
Tobacco is a drug because it causes addiction. Anything that a person can get addicted to is like a drug whether it is actual drugs or food.Tobacco ruins lives just as easily as other drugs. Therefor tobacco is a drug.
The Fourth Amendment
In a work place it is very inappropriate to be under the influence of any sort of drug which is why drug testing should be allowed in a work place. When you are at work you are supposed to be able to do your job to the best of your abilities and when your under the influence performance rates are lower. This can hurt the company or business, the customers and the person as well depending on the type of job
1) I believe that it would be an invasion of privacy if schools gave random drug test. Giving drug test is not necessary. If drugs are not being used on school property the school should not be worried about it. On the other hand if there is proof that a certain student is using drugs on school property than the school should give the student a random drug test so they don't try doing drugs on school property again.
2) If the student is using drugs that improve their performance than they should be kicked on the team. Also if they are under the influence of any illegal drug at a game or practice than they should be kicked off. Other than that they should be allowed to play if they were caught.
3) It should not be included. It's the student's choice and the school should not be able to punish them for it.
4) Tobacco is a drug. It can do severe damage to the human body.
5) The fourth Amendment. It is the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures.
6) It is okay for employers to do random drug test because they should have the right do see if their employees are under the influence on the job.
1. I think that it is an invasion of privacy, but it should also be looked at as a form of protection to people in the building. An also the safety of that individual. If someone has drugs on them, the drugs should be confiscated and punished for illegal activities.
2. I think that if a student wants to be involved in school activities, they should be drugged tested because someone who is involved in drugs does not deserve to participate and experience fun when they are involved with illegal substances.
3.Yes, tobacco should be included because it is a form of drugs and in most cases, students in high school are not legally allowed to use tobacco products.
4. I feel that tobacco is a drug because it is addictive and has some pretty harmful effects .
5.The Fourth Amendment protects the rights of privacy.
6.In a normal job area, I feel that it is appropriate to do random drugs testings because it is not professional to do drugs as an employer and that individual should be punished.
1. Yes it is an invasion of privacy.
2. By testing positive you would be kicked off the team and no longer would be private therefore there is no way to maintain private testing.
3.No
4.Tobacco is a drug you can get addicted.
5. 4th amendment
6.No it shouldn't just like in schools
1.)It is my opinion that drug testing is not an invasion of individual privacy. While you are in school you surrender a lot of your rights. To make the school safer drug testing should be enforced.
2.)If you want to participate in after school activities drug testing should be used to create a fair and also safe environment that will encourage students to try there best and not cheat.
3.) I Think it should be if you are under 18 you should not be smoking it is a illegal if you are over 18 then go for it. I think the punishment should be less severe though.
4.) Tobacco is a drug it has the same addictive quality and has the same bad consequences.
5.) The fourth amendment
6.) Drug testing should be enforced in your work place it should be given as often as possible and it is my opinion that if you receive any government help that if you fail any of these tests your government benefits should be revokes.
1. It is not an invasion of privacy. You are in a public place under certain rules set by the school and one of those rules is not doing drugs. There should be random tests but if the school has reason to believe you are doing drugs they should be allowed administer the test.
2. It is a privilege to participate in extracurricular activities so you should follow the rules so you can participate. If you didn't want to have people know you got kicked off the team for doing drugs you shouldn't have done them.
3. If you are not eighteen you shouldn't be smoking because it's illegal. If you are eighteen then it shouldn't be a problem.
4. Yes. It is addictive and is bad for the body.
5. First amendment, fourth amendment, and fifth amendment.
6. An employer is hiring you to work for them and it should be there right to test you at any time.
1. Random drug testing is most certainly an invasion of privacy. While I concede that if a students offers reasonable suspicion of being under the influence of an illegal substance they should be tested, testing students at random seems just plain ridiculous. Schools have been drug testing for a while now and it hasn't proven to be much of a deterrent. Any student who is willing to accept the physical and mental risks associated with illegal drugs probably won't stop out of fear of an illegal drug test. Who do you go about punishing students found guilty? At my old school you wouldn't get anything but a call home after your first failed drug test. Is that really going to stop anyone? Is there really a tangible difference in school safety because a few calls home?
2. I don't think we should drug test professional athletes, much less high schools ones. At my old school in San Antonio they drug tested students in extracurricular activities yet it never stopped anyone who wanted to use drugs from using drugs. In fact, you knew by the first period of school that day they were doing drug tests and might call you later. Given that much time students often came up with clever (and disgusting I may add) ways of passing the drug test. In addition to the obvious switcheroo with a sober student one method many students opted for was to simply claim they “couldn't go.” The school would keep these students in the office until they either took the test or school was over at which point they'd have to release them.
I don't see why some of the responses on this post seem to argue that while while random drug tests are unfair athlete tests are necessary. Are we really putting that much value on games? There are steroids injected in the cows and chickens we eat every day and there are many medical uses for performance enhancing drugs yet people have the audacity to get on a soap box and complain about their application in games. What is the difference between a student popping pills or smoking and an athlete using steroids? Granted one is for self gain and ambition but there both illegal in the instances we're talking about. People conceding that drug testing is an invasion or privacy while still arguing it's application among athletes come off as hypocritical. High school sports shouldn't be where we draw the line for civil rights. Students not caught taking performance enhancing drugs will pay for it in the long run once those side effects begin catching up with them.

Another problem with drug testing in general is that there is a margin for error. I don't feel comfortable ruining a student's college prospects or a student athlete's recruiting prospects with that margin for error which is estimated as high as 3% by some sources. You may scoff at that because three is such a small percentage but I would argue that if you were in the position of the three percent you would be begging for fairness and accuracy too. The most accurate form of testing we have is the olympic style blood testing but we cannot draw blood from students at random to protect the integrity of glorified games.
3. Tobacco should be included in drug testing programs aimed at minors.
4. Tobacco is a drug because of the effects it has on the human body.
5. The fourth which protects against search and seizure without probably cause or a warrant and the fifth which protects the right to due process.
6. It depends on the job. You shouldn't drug test employees at the gas station or Water Burger. Drug test employees whose jobs pertain to children and public safety. Bakers and plumbers don't protect nuclear launch pads and shouldn't be treated as such. Some say drug testing employees is fine because they should be sober on the job anyways but I argue that if there isn't a noticeable difference in their performance then there is no reason to test them.
1.) I don't think it's an invasion of privacy because it's illegal for students to be doing those drugs. If a student is against being tested for drugs, they are likely using them.
2.) I think especially students participating in sports should be tested.
3.) I think tobacco products should be included because they are also illegal, as long as the students are under 18.
4.) Yes.
5.) The fourth amendment.
6.) Yes, because drug use is illegal.
1) I do think that drug testing at school in an invasion of a person privacy. It is testing them for something without any reason to test them, however I do believe that schools should be able to test for drugs because I believe it may save the lives of kids that get mixed up in things like drugs. Maybe if they could be caught before there life is at risk of being ruined they could get turned around. Drugs are illegal for everyone and schools should have the rights to keep drugs out whether it means drug searches or drug tests.
2)Likewise drugs testing should be allowed for sport teams. People who work with certain machinerary can be subjected to random drug testing. Drugs are bad for your health and it is unsafe for anyone to miss use drugs but especially athletes.
3)I think tobacco testing needs to be treated in a different way for schools, because some kids that are still in school are of age to have tobacco products. Besides that tobacco should still be tested.
4)Yes, tobacco is highly addictive. It have serious and very harmful effects.
5)The 1st amendment allows freedom of speech, press, petition, religion, and to assemble peaceably. The 4th amendment protects the right to privacy.
6)I also believe random drug testing should be allowed in places of employment. Employers have the right to protect their places of business from drugs. I believe the most we drug test the less drugs will be used. Maybe by minimizing drug users, then we can protect our streets from drug dealers and drug wars.
1. I believe that it is an invasion of the privacy. Most of the time, people will know who did take drugs and fail the tests. Pretty sure the schools already know that almost 50% of the kids do drugs. Just doing a drug test, and them getting caught won't stop them now.
2. I believe that in sports there should be drug testings. For example if someone's take illegal drugs like steroids, that shouldn't definitely be tested.
3. I think tobacco products shouldn't, most teens smoke with or without school/parental permission, as long as it's not smoked on school property, than I don't see the problem.
4. I believe that tobacco is a form of drug, because it's addicting, but yet again, it's not as bad as lets say heroin or cocaine or anything like those. Schools and authorities should worrying more about teens or anyone that does the illegal drugs, rather than tobacco.
5. 4th Amendment.
6. Random drug testing should be allowed for employment, most places are already doing it. 1. I believe that it is an invasion of the privacy. Just doing a drug test, and them getting caught won't stop them now.

6. Random drug testing should be allowed for employment, most places are already doing it.
1. I think its an invasion of our privacy. We really don't need it, and the results of the test get spread around school fast, ruining that students reputation. Having drug tests in our school would cause a big problem, and we don't need that.
2. It should be the same for sports, honestly if their a good player, and add value to the team. Just leave whats good alone.
3.No tobacco shouldn't be allowed. Schools shouldn't be allowed to do drug testing, students have no choice but to come to school.
4. Yes it is. It is something people can become addicted to.
5. 4th amendment.
6. It depends on the job of choice you want. anything that has to do with law enforcement, and stuff that has to do with hospital
( because your dealing with peoples lives). But other then that no.
1. No I don't think it is an invasion of individual privacy because if u are tested and you don't do drugs then u have nothing to hide. If you do do drugs and you are tested the school will help u get help. It will also make the school a safer environment.
2. I believe that they should because if students want to participate in there activity they they won't do drugs.
3.I think it should because unless the student is 18 or older it is illegal.
4. Yes i believe it is.
5. The 4th Amendment.
6. They should have drug testing at your place of employment because you can't do your best or be the best at your job if you are doing drug.
1. I definitely think that random drug tests of students is an invasion of person privacy, students go to school to learn, not to be randomly drug tested. 2. These activities should be the same, nobody should your activity away for doing drugs, and it makes you look bad. 3. No 4. Yes 5. 4th Amendment 6. Definitely not, nobody has the right to give drug tests except for the police
1. I think random drug testing should be something that should happen at least two times a year at school. Your in a public school system therefore privacy should not be an issue.
2. I think it should be mandatory to have drug testing for extracurricular activities because if a well known druggie is a sports hero, what kind of message is that sending to the younger children.
3. Tobacco products should not be included in the drug testing, unless the person being tested is underage.
4. I don't really consider tobacco a drug in this case. Compared to heroin or cocaine its nothing.
5. The constitutional amendment is the 4th.
6.Random drug testing should be allowed for places of employment depending on what the person is applying for. If its a fast food job then no, but if the job was a police officer then yes.
1. It is not an invasion of privacy. Schools are government owned meaning that it is perfectly fine to administer random drug tests.
2. Extra Curricular activities are like sports, they should be treated the same and students should be tested.
3. I think tobacco should be tested, but if a student 18 or over is found with tobacco in his or her system then that student should not be in trouble because he/she is the legal age.
4. Tobacco is a drug, but it is legal, meaning that a student that is over the age should not be in trouble for having it in their system. It does not mean that tobacco was smoked on school grounds.
5. 4th Amendment
6. It all depends on what field. Government workers should be subject to this, since they are running our country. Other non-government organizations should have optional drug tests.
1. No its not because drugs are no ones business to be using and if they decide to use them they should get punished because they are illegal.
2. Drug test shouldn't effect students extracurricular activities or anything to do with the school. It is an issue with the law and only that.
3. No they shouldn't
4. No it is not.
5. People have the right to make their own decisions but if its illegal decisions then its different.
6. Yes, it should be allowed for random drug tests to be done at a work place.
I think it is an invasion of privacy because what happens out of school stays out of school. Since it is not done around school they shouldn't be able to test people in school.
For extracurricular activities should be treated the same way. If it is not seen in school property and or during away games they shouldn't have a right to test the players.
Tobacco shouldn't be included. It is probably used to solve a possible problem. Yes, it is addictive but it's not necessarily a drug.
Tobacco does harm your body but doesn't have the effect like other substances so no. It's not.
The Fourth Amendment.
If the job insists of heavy machinery and it's a dangerous environment then yes there should be random drug testing.
1.) yes i think it is an invasion of privacy to do random drug testing at a school, we have no choice but to be here so it is not fair.
2.) for extra curicular activities i think it ok because your not being required to attend something plus if you are in a sport then there is a good chance you are not using any drugs.
3.) i do not think that tobacco should be included in a drug test its not like other drugs it doesnt hinder you in any way and you could test positive just from being around it and inhaling 2nd hand smoke.
4.) i dont not think that tobacco should be considered a drug it doesnt change the way you think if it is considered a drug you shouldnt be allowed to smoke and drive just like you cant drink and drive.
5.)the 4th amendment pertains to drug testing under the search and seizure.
6.) you should be allowed to do random drug testing at places of work your the one that chooses to be there so if its a part of their policy that you are drug free then it should be allowed
1.) Random drug testing is not an invasion of privacy for students. When you are in school you are subject to there rules and that means no drugs, alcohol, tobacco, etc. Many students do drugs and its not good. Maybe by random testing people it would cause them to quit.
2.) Extracurricular activities should be treated the same way or even more strictly. Participating in sports is a privilege and can be abused. If you subject yourself to drugs and tobacco use in school that privilege should be taken away.
3.)No tobacco should not be included in the testing. Though its true tobacco is illegal for people under 18, it is not really enforced all that much. Many people smoke or chew and yes it could lead to long term health problems but the school shouldn't do anything about it. Unlike drugs that are illegal for everyone.
4.) Yes tobacco is a drug because its addictive and bad for you but its not a serious drug.
5.)The Fourth Amendment protects your right to search and seizure.
6.) Drug tests should definitely be mandatory at jobs because you are getting payed to do a task and you should not be on drugs which hinder your ability to do that job. Plus it could be dangerous to be high doing some jobs.
1. no i think its very appropriate, even though adults should not smoke or do drugs, teenagers rest of their lives. its for their own safety.
2. teens shouldnt be able to participate in activities if they're on drugs
3. unless the students are 18, yes tobacco should be included
4. yes, its addictive and harmful to your body
5.Amendment 14
6.i think it deffinately should be a requirement tp be drug tested at a job
1. I don't think that random drug testing is an invasion of privacy. Having drug tests would ensure the safety of students, make school drug free, and help students to get the assistance they need for their drug issues.
2. Being in extracurricular activities is a privilege. If students are abusing drugs and breaking the law they should be punished. Especially for clubs that depend on being a leader and being a good role model. Breaking the law and abusing drugs is not being a good role model. Students who are caught doing drugs should be kicked out of clubs and off sports teams.
3. Tobacco should be included. Our school along with many others is tobacco free, and many students are under 18, therefore tobacco is illegal for them.
4. Tobacco is definitely a drug,. It is addictive and has harmful effects on the body.
5. Amendment 4 grants the right against unlawful searches and seizure,
5. Random drug tests should be administered in the workplace too. It is a professional environment where drugs should not be present. Also it is wrong to work while intoxicated or high, so precautions should be taken to make sure workers are not under the influence.
I do not think that random drug testing is an invasion of privacy students come here to learn not walk around school high all day and snorting adderall off of urinals. If teens use drugs any type they should not to be allowed to participate in extracurricular activities. Unless students are at the legal age of 18, then it should be included. Amendment four is the one that protects use. Drug test should be required at work places.
1) it's definitely an invasion of individual privacy. There is no need for schools to abuse their power and have everyone take a drug test. What students do outside of school is their business. What are the schools going to do if a student tests positive?
2) it's still an invasion of privacy.
3) no.
4) it's addicting like a drug, and a lot more dangerous long term than most of the drugs we see around here, but I don't consider it an actual drug. It can be legally bought and sold.
5) amendment 14
6) definitely
1. I do no think it is an invasion of privacy to have random drug testing, our school is a drug free environment which is used to learn and increase our eduction. Students should not be coming to school under the influence of drugs.
2. Being in extracurricular activities in a privilege. If a student has poor grades they are punished until they bring their grades up, the same should follow if they are using illegal drugs.
3. Tobacco is considered a drug, many schools including ours is a tobacco free campus. If the student is under 18 it is illegal for them so they should be punished.
4. I think it is considered a drug because it is addicting and has bad health affects for later on down the road.
5. The 4th amendment protects the right against unlawful searches.
6. Drug tests should be administered in the work place because drugs are not allowed in the work place. People should be giving their all while working and can not do so if they are under the influence of drugs.
1.Yes, it's an invasion of privacy. Some kids who get straight A's their whole highschool career do drugs. It wouldn't be fair to the kids who are thought of highly. It's different when a kid is comming to school high but what they do on the weekends should not affect their school career. If a kid gets high but gets his paper done on time then what's going to be achieved by drug testing. I guarantee the drop out percentage would sky rocket if this happened.
2. Same as #1. They're going out of their way to do someone thing extra for their school and be part of the communitie. There is no reason they should be denied that opportunity because their system isn't socially acceptable.
3. No because it doesn't alter their mind in the sense of a "high". A kid will still be able to properly take a test if they smoked a butt.
4. Yes, kills so many people every year.
5. 4th.
6. No because if they're good at what they do then there's no reason to get fired over what they do in their free time.
